  • Dispute Avoidance and Resolution for Enterprises of the Philippines

    Session 1: Dispute Avoidance: legal risk management and protection of intellectual property rights

    Under the Belt and Road Initiative, there are enormous investment opportunities and business cooperation for enterprises in the Mainland and the Philippines. In this session, eminent speakers with extensive experience in international trade law and cross-border dispute resolution will share their insights on how to manage legal risks and avoid disputes when the Philippines enterprises expand business worldwide, particularly in Mainland China. The speakers will provide practical tips on contractual drafting including the choice of the governing law and the drafting of dispute resolution clause in the contractual stage. Speakers with expertise in IP matters and dispute resolution will also share with audience how they may protect their intellectual property rights (“IPRs”) when doing cross-border business, particularly in Mainland China. The speakers will discuss the advantages of resolving IPRs disputes in Hong Kong and give a brief introduction on how to resolve disputes over IPRs by arbitration.

    Session 2: Into a new era: latest developments in dispute resolution

    In this session, speakers who are leading international dispute resolution practitioners will discuss what Hong Kong may offer to resolve disputes. In particular, how the Philippines enterprises can make use of the “Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region” (which came into effect on 1 October 2019), when when resolving cross border disputes with their counterparts in Mainland China. This panel will also discuss the latest development in online dispute resolution, which is gaining international recognition and attention.
